1. Acceptance of Terms

By accessing or using the CargoBloom website ("Site") and the CargoBloom browser extension ("Extension"), collectively referred to as the "Service", you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and CargoBloom. Please read them carefully before using our Service.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Description of Service

CargoBloom provides market intelligence and analytics for the logistics industry. The Service includes:

  • A public web dashboard displaying aggregated freight market data.
  • A browser extension that assists users by providing market rate insights while browsing third-party freight exchange platforms (Trans.eu, Timocom).
  • User accounts with watchlist functionality for tracking specific routes.
  • Enterprise analytics tools for benchmarking and reporting (future feature).

4. User Accounts

To access certain features of the Service, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

5. User Obligations

You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree not to:

  • Use the Service in any way that violates any applicable national or international law or regulation.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated systems (bots, scrapers) to access the Service beyond the intended Extension functionality.
  • Circumvent rate limits or other security measures.
  • Share your account credentials with third parties.
  • Use the Service to transmit malware, viruses, or other harmful code.
  • Interfere with or disrupt the Service or servers connected to the Service.

6. Third-Party Platform Compliance

The CargoBloom Extension operates on third-party freight exchange platforms (Trans.eu, Timocom). You acknowledge and agree that:

  • You are solely responsible for maintaining an active, authorized account on these platforms.
  • Your use of these platforms is governed by their respective terms of service.
  • CargoBloom is not affiliated with, endorsed by, or sponsored by these platforms.
  • We only collect publicly visible market data that you can already see in your browser.
  • If a third-party platform prohibits the use of browser extensions, you should not use our Extension on that platform.

7. Data Collection and Usage

The CargoBloom Extension collects anonymized market data (such as route offers, prices, and vehicle types) visible to you on supported platforms. By using the Extension, you contribute to the community data pool. Please refer to our Privacy Policy for detailed information on how we collect and use data.

You grant CargoBloom a non-exclusive, worldwide, royalty-free license to use, process, and display the aggregated market data you contribute through the Extension for the purpose of providing and improving the Service.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of CargoBloom and its licensors. The Service is protected by copyright, trademark, and other laws of applicable jurisdictions.

You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code of our software, unless laws prohibit these restrictions or you have our written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Accuracy, reliability, or completeness of market data.
  • Uninterrupted or error-free operation of the Service.
  • Correction of defects or errors.

Freight rates displayed are estimates based on historical and real-time data and should not be considered as binding offers or guarantees of actual market rates. Always verify rates independently before making business decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CARGOBLOOM, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, data, use, goodwill, or other intangible losses.
  • Any damages resulting from your access to or use of (or inability to access or use) the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless CargoBloom and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property rights or privacy rights.
  • Your violation of any applicable law or regulation.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your use of the Service at any time by:

  • Uninstalling the browser extension.
  • Deleting your account (if applicable).
  • Ceasing to use the website.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the European Union and the member state in which CargoBloom is established, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction. However, this does not affect your statutory rights as a consumer under the laws of your country of residence.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by:

  • Posting the updated Terms on this page with a new "Last updated" date.
  • Sending an email notification to registered users (if applicable).
  • Displaying a notice within the Service.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CargoBloom regarding the Service and supersede all prior agreements and understandings.
